ABOUT THE LAW AND ANY EXCEPTIONS

CAN MARRIED OR PREGNANT GIRLS GO TO SCHOOL?

The Civil Code allows marriage at 17 with parental consent, and at 16 under exceptional circumstances, with court approval.

In 2015, the Constitutional Court ruled that those involved in religious marriages, where there is no prior civil marriage, would no longer be penalised. Previously, the Turkish Penal Code stated that the spouses and officiant of such a marriage would face 2-6 months imprisonment. The Constitutional Court ruling did not, however, make standalone religious marriages legal. As such, the absolute minimum age allowed by law remains 16.

In 2016 and in 2020, attempts were made to create laws which would allow men to marry girls they had sexually abused. These 'marry your rapist' laws did not progress.

No explicit law prevents or protects the right to education for married, pregnant, or parenting girls.
