ABOUT THE LAW AND ANY EXCEPTIONS

CAN MARRIED OR PREGNANT GIRLS GO TO SCHOOL?

According to the Marriage Act, parental consent is required for anyone aged 18-20 who wishes to marry. However, in Tuvalu customary law is formally recognised, which enables customary marriages to take place. The Matrimonial Proceedings Act, which outlines the rights of the spouses in the case of marriage breakdown and divorce, explicitly states that it is applicable to customary marriages as well as civil marriages. The Marriage Act does not state that it applies to customary marriages. It is unclear if there is a minimum age for customary marriages in Tuvalu.
